Charter Administrative Hearing Committee

The Administrative Hearing Committee is a committee composed of no less than three (3) and no more than five (5) IBBA members in good standing that are appointed annually by the Board Chair to hear any grievances between and among members or situations that arise that appear to be in violation of IBBA's Code of Ethics and/or Standards. The committee is charged with investigating and documenting such proceedings, conducting an appropriate hearing and recommending to the Board of Directors all of the following, but not limited to, censure, suspension, expulsion, revocation of membership, limitation of use of member benefits, and /or letter of reprimand.

In accordance with Article II, section 2.05 Termination for Cause, the member(s) shall be given notice by US mail, private express delivery, facsimile or other electronic means permitted under the laws of the State of Texas in advance of such hearing at the member's last recorded address on the records of the Association. The members shall have the right to be heard on the charges, to be represented and to present witnesses. Rev. 4/16/04

Duties of the Chairman of the Administrative Hearing Committee

  • Attend all meetings and conference calls of the committee
  • Prepare for committee meetings by preparing and reviewing the agenda and researching issues to be discussed at the meeting in accordance with the Committee Charter
  • Actively participate in discussion at the meeting
  • Follow through promptly on any assignments for the Committee
  • Support committee recommendations before the Chairman and the full board
  • Prepare a written report for the Board of the Committees activities and recommendations
  • Work with the Vice Chair to evaluate its own operations and action items
  • Keep the member subcommittee(s) (if any) on focus
  • Communicate to Committee members, affiliates and other interested parties
  • Record minutes of each meeting and publish same after each committee meeting
  • Assist Vice Chairman and staff with follow-up or assignments of subcommittees and working groups
  • Attend other meetings when requested by the chair as the representative of the Committee and the Association
  • Other duties as they may be neede
